What is the diversity lottery?

Chantal was a French citizen attending school at the University of Maryland when she learned about the Diversity Immigrant Visa Program. The program is based on Section 131 of the Immigration Act of 1990 which created a new class of immigrants known as "diversity immigrants" (DV immigrants). The Act made 50,000 permanent resident visas available annually to people from countries with low rates of immigration to the United States.

Chantal wanted to remain with her family in the United States after graduation. She had heard from friends that getting a green card through employment was an arduous process, so she decided to enter the diversity lottery.


Who is eligible for the diversity lottery?

Chantal consulted with an attorney to make sure that she was eligible for the Diversity Lottery. The attorney told her that the eligibility requirements for the Diversity Immigrant Visa Program were as follows:

-The applicant must be a native of one of the qualifying countries.

-The applicant must have a high school education or its equivalent, defined as successful completion of a 12-year course of elementary and secondary education.

-If the applicant does not have a high school education, he or she may substitute two years of work experience, within the past five years, in an occupation requiring at least two years of training or experience.

Since Chantal was a native of France, one of the qualifying countries, and had a high school education, the attorney told her that she qualified to enter the Diversity Lottery.

Chantal gave her attorney the following information for the Diversity Lottery form:

The attorney submitted Chantal's application electronically at www.dvlottery.state.gov, along with digital photographs of Chantal, her husband, and her daughter. There was no entry fee. Chantal did not submit more than one application for herself since that could disqualify her. In the next few months, the State Department selected applicants at random from all the qualified entries. Chantal's application was selected, and the State Department notified her by mail. (Applicants not selected will not receive any notification.) Chantal and her family applied for adjustment of status the following fall.
